Acceptance of Terms
By downloading, installing, or using Aquarium Zen: Retro ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
Description of Service
Aquarium Zen: Retro is a relaxation and entertainment application that displays animated pixel-art aquarium scenes on your iOS device. The App includes configurable settings, a home screen widget, and an optional focus timer. The App operates entirely offline and does not require an internet connection.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions.
Intellectual Property
All content in the App, including but not limited to graphics, animations, code, and design, is owned by us and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
User Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to the App's source code
- Use the App for any unlawful purpose
- Redistribute or make the App available over a network where it could be used by multiple devices simultaneously
Focus Timer Disclaimer
The built-in focus timer is provided as a convenience tool. It uses a system sound alert and is not intended as a medical device, alarm system, or critical-use timer. We are not responsible for any consequences resulting from missed or inaudible timer alerts.
Idle Timer Behavior
The App disables the automatic screen lock (idle timer) while in use to function as a continuous display. You are responsible for managing your device's battery and power usage while the App is in use.
Provided "As Is"
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Third-Party Terms
Your use of the App is also subject to Apple's standard end-user license agreement (EULA) for licensed applications.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions. Nothing in these Terms limits or excludes any consumer rights that you have under the mandatory laws of your country of residence that cannot be waived by agreement.
Apple as Third-Party Beneficiary
You acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
Changes to These Terms
We may update these Terms of Use from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised terms.
